These Terms of Service (“Terms”) describe the rights and responsibilities regarding the Menergy Meds website and platform (the “Platform”) owned and operated by Menergy Meds, Inc. The Platform facilitates healthcare services including health record development, administrative scheduling support, prescription coordination, and telecommunications with medical providers.

The Menergy Meds Platform is intended for specific non-emergency medical conditions only. If you are experiencing a medical emergency, call 911 immediately.

Menergy Meds is not a medical provider and does not control the independent medical groups or pharmacies that use its platform. Use of the Platform is governed by these Terms and our Privacy Policy. By accessing the Platform, you acknowledge and agree to be legally bound by these Terms.

Menergy Meds reserves the right to amend these Terms at any time. We encourage you to review this page periodically. Continued use of the Platform following any amendments constitutes your acceptance of the revised Terms.

The Platform facilitates: healthcare record gathering, administrative scheduling support, prescription fulfillment coordination, and telecommunications with medical providers.

Menergy Meds does not provide Healthcare Services through the Platform and is not licensed to practice medicine. Medical providers on the Platform are independent practitioners solely responsible for the healthcare services they provide. Menergy Meds does not manufacture medications; all medications are dispensed by independent, licensed third-party pharmacies.

To use the Platform, you must:

• Be at least 18 years of age
• Be located in a U.S. state where our services are available
• Be able to form a legally binding agreement under these Terms
• Have access to compatible computing devices and internet connectivity

Meeting these requirements does not guarantee access to services.

Services are available only in certain U.S. states. Please contact help@menergymeds.com for current availability in your state.

Registration is required to access services. By submitting information through the Platform, you grant Menergy Meds the right to use, reproduce, modify, and analyze your data as necessary to provide services, improve products, and fulfill operational requirements. Your data may be shared with service providers, medical professionals, and affiliated entities as described in our Privacy Policy.

You agree to:

• Provide accurate, complete, and current information
• Keep your login credentials confidential
• Update your information as needed
• Notify Menergy Meds immediately of any unauthorized access to your account
• Understand that inaccurate or incomplete information may result in account suspension or inability to provide services

You may not:

• Use the Platform on behalf of anyone other than yourself
• Access the Platform in violation of intellectual property rights or applicable laws
• Attempt to circumvent security measures or gain unauthorized access
• License, sublicense, sell, or distribute the Platform or its content
• Create competing products or services using information from the Platform
• Introduce viruses, malware, or other harmful code
• Remove or alter trademarks, notices, or intellectual property identifiers
• Monitor, scrape, or copy content without written authorization

Menergy Meds grants you a personal, limited, revocable, nonexclusive, and non-transferable license to view and use the Platform for personal, non-commercial purposes only, subject to these Terms.

The Platform is not, and should not be considered or used as, comprehensive medical advice, care, diagnosis, or treatment. You should consult with a qualified healthcare provider before starting, changing, or discontinuing any treatment or medication.

Telehealth uses electronic communications to connect patients and healthcare professionals. While telehealth offers significant benefits, it carries potential risks. You must review and agree to our Telehealth Informed Consent before receiving healthcare services through the Platform. See our Medical Consent page for full details.

By submitting your information and selecting a plan, you authorize charges for services rendered. Medical consultation fees are non-refundable. All sales are final. You are responsible for all applicable fees including those from medical providers.

Payment information is processed securely through Stripe. Menergy Meds-affiliated medical professionals are not contracted healthcare providers with any health insurance plan and services may not be covered by insurance.

We value the confidentiality of your information. Please review our Privacy Policy for complete details on how we collect, use, and protect your data.

Menergy Meds is the sole and exclusive owner of all right, title, and interest in the Platform, including all content, features, functionality, trademarks, and trade names. You may not use any Menergy Meds trademarks without prior written permission.

The Platform may contain links to third-party websites. Menergy Meds is not responsible for the content, accuracy, or practices of linked websites. Links are provided for convenience only and do not imply endorsement.

The Platform and Services are provided on an “as is” and “as available” basis. Menergy Meds makes no warranties, express or implied, regarding merchantability, fitness for a particular purpose, accuracy, security, or uninterrupted availability of the Platform.

Neither Menergy Meds nor its related persons or licensors will be liable for any indirect, punitive, special, incidental, or consequential damages arising from your use of the Platform. Total liability shall not exceed $100 USD, except where applicable law prohibits such limitations.

You agree to indemnify and hold Menergy Meds harmless from any third-party claims arising from your breach of these Terms, unauthorized use of the Platform, or violation of applicable laws.

Menergy Meds may modify, suspend, or discontinue the Platform at any time without prior notice or liability.

You may terminate your use by discontinuing access to the Platform. Menergy Meds may terminate your access with or without notice for any reason. The following provisions survive termination: Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.

All disputes between you and Menergy Meds will be resolved exclusively by binding arbitration, except that you may assert claims in small claims court if eligible.

• Class Action Waiver: Class or representative arbitrations are not permitted under any circumstances.
• Jury Trial Waiver: You waive your right to a jury trial.
• Opt-Out: You may opt out of arbitration within 30 days of account creation by sending written notice to Menergy Meds, Inc.
• Governing Law: These Terms are governed by the laws of the State of Florida.
• Arbitration Rules: The American Arbitration Association (AAA) Consumer Arbitration Rules apply.

Menergy Meds complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the Platform infringes your copyright, submit a DMCA notice to help@menergymeds.com including: identification of the copyrighted work, location of the infringing content, your contact information, and a statement under penalty of perjury that the information is accurate.

These Terms constitute the entire agreement between you and Menergy Meds. If any provision is found invalid, the remaining provisions remain in full effect. Failure to enforce any provision does not waive future enforcement rights. You may not assign your rights or obligations without written consent from Menergy Meds.
